  • you are making a garden waste enquiry
  • you are requesting a Christmas tree collection
What is a Privacy Notice?

A Privacy Notice is a statement issued by an organisation which explains how personal and confidential data about individuals is collected, used and shared.

Who is collecting and using your personal data?

Swindon Borough Council will act as a “Data Controller” for any personal data that you provide to us. We will ensure that the data given to us is processed in line with our Data Protection Act 2018 (DPA 18) and the UK General Data Protection  Regulations(GDPR).

Please note that not providing your personal data may lead to you being unable to utilise services provided by waste and recycling services.

Your personal data – what is it?

Personal data relates to a living individual who can be identified from that data. Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of data is governed by the General Data Protection Regulation 2016/679 (the “GDPR”).

What personal data do we collect?

Swindon Borough Council collects a range of data about you in order to deliver the garden waste collection service. This includes your name, address, email address, telephone number and unique Garden Waste Subscription reference where provided.

Card and bank details required to make payment for the service are collected directly by our third party partners (Capita for card transactions and FCC for Direct Debit) on behalf of Swindon Borough Council.

How do we process your personal data?

Swindon Borough Council complies with its obligations under the UK GDPR. This means it keeps personal data up to date; stores and destroys it securely; does not collect or retain excessive amounts of data; protects it from loss, misuse, unauthorised access and disclosure; ensures that appropriate technical measures are in place to protect it. Also processed through the My Account.

Why do we need your personal information?

The personal data provided is used to deliver the garden waste collection service, including:

  • to provide the containers, mailings and collections required to carry out the service
  • to contact you regarding specific delivery aspects of your garden waste collection services; this may include service information or collection details
  • to monitor demand on and performance of collection services particularly around missed collections but wherever possible this information would be anonymised
  • to contact you to manage your garden waste account or answer your enquiry
How the law allows us to use your information?

We are collecting the personal information as it is necessary to fulfil the garden waste collection contract which is subject to terms and conditions Article 6 1[b] UK GDPR.

Who do we share your information with?

We will not share your data with any third party including other departments of the Council unless specified below.

  • Subscription and address details are securely shared with our mailing provider in order to deliver necessary postal mailings regarding the garden waste collection service.
  • Details obtained by our payment partners will be used solely for the purpose of taking payment and not used or shared for any other purpose.

We may need to share the information with others outside the council if there is a legal duty to do so, for example

  • the prevention and detection of crime and fraud
  • if there are serious risks to public, staff or other professionals
  • to safeguard the protection of a child or vulnerable adult
How do we protect your information?

We will do what we can to make sure we hold records about you (on paper and electronically) in a secure way, and we only make them available to those who have a right to see them.

How long do we keep your personal information?

We will keep your information for as long as you have a relationship with us. Specific information relating to this service will be retained for 7 years after the service is no longer renewed.

What you can do with your information?

Under the Data Protection Act 2018 and the UK GDPR you have the following rights:

  • The right of access to you own personal data
  • The right to request rectification or deletion of your personal data
  • The right to object to the processing of your personal data
  • The right to request a copy of the information you provide us in machine-readable format
  • The right to withdraw your consent to any processing that is solely reliant upon your consent

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes.

Your right to complain

In the event that you wish to complain about the way that your personal data has been handled by Swindon Borough Council, you should write to the Data Protection Officer and clearly outline your case. Your complaint will then be investigated in accordance with our customer complaint procedure.

What if you do not provide personal data?

You are under no statutory obligation to provide personal data to Swindon Borough Council during the garden waste subscription or enquiry process. However, if you do not provide the data for the purposes above, we may not be able to provide the collection service to you or answer your query.

How will we ensure compliance?

A yearly audit will normally take place on personal data to ensure that we remain legally compliant in accordance with current data protection legislation.
